Did you lost the:

"If you do not fight, He will punish you sternly, and replace you by 
other men." (Surah 9:37-)

The Muslims refusing to fight openly are considered as traitors and 
treated as such, when the time come.

Combining (Surah 9:37-) with
"make war on the leaders of unbelief...Make war on them: God will 
chastise them at your hands and humble them. He will grant you victory 
over them..." (Surah 9:12-)

And you give the rioting Muslims the right to punish the not rioting 
Muslims (or worse, the Muslims working or helping not Muslims against 
other Muslims).
