Regarding your comment that POTUS does spend money not authorized by congress and the courts eventually rule on it, what that demonstrates is that we need originalist justices on the SCOTUS.  The constitution very clearly defines the roles in government.  POTUS is not authorized to spend money congress has not authorized.
