Along with this is the notion that the executive branch has become too
powerful with respect to the legislative and judicial branches.
But note two important developments: the appointment of two
literalist/originalist justices to the supreme court, who have supported
decisions specifically limiting executive branch power, such as overturning
Roe and the Chevron decision in June 2024. The constitution doesn't empower
the executive branch to make law. The extensive executive branch
bureaucracy used to make regulations, which became the functional equivalent
of law. Now the executive branch bureaucracy is busily working on
suggestions.
DOGE came along asking why we need all this bureaucracy to offer us
suggestions and opinions. We don't! So why are we spending all this money
on it? We shouldn't!
The reality of our times is the legislative branch is effectively ceding
power by failing to work together with the opposing mainstream party. One
of the consequences of polarization of the two mainstream parties is that
they cannot work together. They cancel each other's power, which dumps
power back over into the executive branch, even as the supreme court
clarifies the limits of executive branch power. Ben this is the great
paradox of our turbulent times.
